I'm not sure who originally asked for physician references to testify that there
is a
causal relationship between Hep B injections and TM but I have some concerns/
questions. Bob or someone more closely aligned with the legal field will
hopefully
add to this.
Having worked myself as an expert witness for the past 20 years it has been my
experience that a law firm who specializes in some form of medical malpractice
would have their own experts. The logic and rationale behind this has to do with
a variety of legal practices. Secondly, there have been a number of legal
decisions
that establish that if a foreign matter (e.g., hep B serum) is injected into the
body
resulting in an ailment that this ailment has to occur within a certain period
of time
after the injection or it is not legally seen as a causal relationship. i.e.,
hep b injection causes TM. I would think that this firm would be aware of these
decisions and share
it with the client.
The reason for this post and the information I do have on the topic of
injections and
TM is that for some time I pursued some research on the relationship between
Smallpox vaccinations and TM. I had had multiple smallpox injections when I went
into the Air Farce back in the early 1960's and I was trying to establish that
my TM
was military service connected thus it would be compensable by the Veteran's
Administration. I know that a lot of Law firms state that they are working on a
contingency basis but most of the contracts state that the firm is entitled to
xx%
of any monetary settlement plus expenses and if no money is recovered they do
not
receive their %age. Watch out for those expenses.
To help the research on this topic a search in Medline which can be found at
http://www.myelitis.org/tma/index.html will provide some Journal articles on
the relationship between Hep B injections and TM.
Hope this helps.
